Today, in the period of rising prices for urban real estate, the issue of improving citizens' living conditions is becoming more acute. Very often, the townspeople see the solution to this issue in the acquisition of suburban real estate. This article aims to highlight some aspects related to the selection, registration and purchase of a land plot.

What are we standing on?

Before starting to search for the cherished "hundred parts", you need to decide: what, ultimately, do you want to get from them? The first and most common desire is to purchase a land plot for the construction of a residential building for permanent residence. The second is a dacha land plot as part of a dacha cooperative for the construction of a residential building for seasonal residence. Then there are more modest desires: a plot of land as part of gardening or truck farming with or without a garden house for plant growing.

Many have already guessed that such a gradation is not accidental. The thing is that each land plot has its own category, which determines the possible options for its use. There are several categories, but only two are suitable for solving the problems of citizens: agricultural land and land of settlements. With the lands of settlements, everything is more or less clear - the land is allocated for individual housing construction (IZhS), while with agricultural land, the situation is different. There is a Federal Law "On horticultural, vegetable gardening and dacha non-profit associations of citizens" (2005), which clearly defines what and where citizens have the right to build and on what conditions.

Basic concepts:

garden land - a land plot provided to a citizen or acquired by him for the cultivation of fruit, berry, vegetable, melon or other crops and potatoes, as well as for recreation (with the right to erect a residential building without the right to register residence in it and economic buildings and structures)

garden plot - a land plot provided to a citizen or acquired by him for the cultivation of fruit, berry, vegetable, melon or other crops and potatoes, as well as for recreation (with or without the right to erect a non-capital residential building and utility buildings and structures, depending on permitted use of the land plot determined during the zoning of the territory)

summer cottage - a land plot provided to a citizen or acquired by him for recreation purposes (with the right to erect a residential building without the right to register residence in it or a residential building with the right to register residence in it and economic structures and structures, as well as with the right to grow fruit, berry, vegetables, melons or other crops and potatoes). (Federal Law "On horticultural, vegetable gardening and dacha non-profit associations of citizens", Chapter I, article 1.)

Having analyzed the basic concepts from the law and having decided on the possible options for the use of land plots, you can go directly to the search for a plot.

The remoteness of the land plot from the city, its location on the terrain, landscape features, the presence of reservoirs, etc. - all this is decided by the citizens themselves. Experts can only help in choosing and, most importantly, check the legal purity of the "vending" site.

First of all, we study the documents. We determine the owner and negotiate with him directly or with a person representing his interests by power of attorney (notarized!). The main document defining the owner is the Certificate of State Registration of Rights. The second important document is the cadastral plan of the land plot (KPZU). This document requires detailed study, because it is a kind of "passport" of the land. It specifies in detail: the location of the land plot, its size, area, standard value of the land, etc. An important point: if the KPZU has a phrase: "approximate area, subject to clarification during land surveying", this means that the new owner will have to do land surveying.

When making a sale and purchase transaction, this can be a subject of bargaining. The best option is when the area is determined accurately (as a result of surveying) and the boundaries of the site are established. Land surveying and registration of a land plot in the State Cadastral Registration (GKU) are carried out by organizations that have the appropriate licenses on a commercial basis. Often, organizations conducting land surveying have real estate departments that work on their client bases, the information in which has already been verified by specialists in the process of registration.

There are cases when zealous owners do not just land surveying, but order a topographic survey of their land plot (used for landscape design taking into account the relief). Recently, many owners of suburban areas are approaching improvement issues even more broadly, collecting as much information as possible about their site. This is the presence of a water source, and the composition of the soil (whether it is suitable for construction) and soil, and the search for a place most suitable for the installation of local treatment facilities, etc., while modern research methods have become much more accessible in all parameters, in including the cost.

A correctly registered and competently arranged land plot will bring a sense of stability and satisfaction and will delight its owners for many years.
